About these Website Terms

These Website Terms apply to your use of the website at cream.legal and any content made available through it (Website). The Website is owned and operated by Cream Legal Pty Ltd (ABN 98 699 749 669) (Cream Legal, we, us or our), an incorporated legal practice based in Victoria, Australia.

By using the Website, you agree to these Website Terms. If you do not agree with them, you should not use the Website.

General information only

The Website, including but not limited to its descriptions of services, frequently asked questions and AML/CTF information, provides general information only. The content does not take into account your particular circumstances, is not intended to be complete and is not legal, financial, taxation or other professional advice.

You should not act, or refrain from acting, solely because of information on the Website. Specific advice should be obtained before making a decision or taking action in relation to a legal matter. The Website is prepared in an Australian context and does not provide advice about the laws of another country.

Enquiries and the solicitor-client relationship

Using the Website, saving or downloading information from it, or submitting an enquiry does not of itself create a solicitor-client relationship between you and Cream Legal. Cream Legal is not obliged to accept or act on an enquiry.

Before accepting an engagement, Cream Legal may need further information, may conduct a conflict check and may need to complete identity, onboarding or other legal and professional requirements. Cream Legal will act for you only after it has confirmed in writing that it accepts the engagement and you have signed and returned the applicable costs agreement.

The general enquiry form is intended for a brief initial description of your matter and does not accept file attachments. You should not submit identity documents or confidential or highly sensitive information through that form. If a matter is urgent or subject to a deadline, you should not rely on the enquiry form. Submitting an enquiry does not guarantee that it has been received or reviewed by any particular time.

Information submitted through the Website will be handled in accordance with Cream Legal's Privacy Policy and any applicable legal and professional obligations.

If Cream Legal accepts an engagement, the legal services will be governed by the applicable engagement letter, costs disclosure, costs agreement and any other terms agreed in relation to the matter. These Website Terms apply only to the use of the Website and do not govern those legal services.

Accuracy and currency

Cream Legal takes reasonable care in preparing the Website but does not warrant that its content is complete, accurate or current in every respect. Legal and regulatory requirements, third-party information and the services offered by Cream Legal may change. Website content is current only at the date stated or, if no date is stated, at the date it was published.

Cream Legal may change, remove or replace Website content without notice and is not obliged to update information immediately after a change in law or circumstances.

Permitted use

You may browse the Website, print or save reasonable extracts for your personal and non-commercial use, and link to a publicly available page, provided that the use is lawful, fair and does not imply that Cream Legal endorses, sponsors or is associated with you or any third party.

Unless permitted by law or authorised by Cream Legal in writing, you must not copy, modify, reproduce, republish, distribute, sell, license or commercially exploit any substantial part of the Website or its content.

Prohibited use

You must not use the Website unlawfully; interfere with its operation or security; attempt to gain unauthorised access to any system or information; introduce malicious code; systematically scrape or harvest Website content for commercial purposes; or use Cream Legal's name, branding or content in a way that is misleading or suggests an association that does not exist.

Intellectual property

Unless otherwise indicated, copyright and other intellectual property rights in the Website and its content are owned by or licensed to Cream Legal. Rights in third-party content remain with the relevant owner. Cream Legal's name, logo and other branding must not be used without prior written permission.

No intellectual property rights are transferred to you by your use of the Website. The limited permissions in these Website Terms do not apply to any paid product, template or other material that is supplied under separate terms.

Third-party websites

The Website may contain links to websites operated by third parties. Links are provided for convenience and do not necessarily indicate endorsement. Cream Legal does not control those websites and is not responsible for their content, availability, security or privacy practices. Your use of a third-party website will be subject to its own terms and policies.

Liability

To the extent permitted by law, Cream Legal is not responsible for loss or damage arising from your use of, inability to use, or reliance on the Website or its general content.

Nothing in these Website Terms excludes or limits any right, remedy, guarantee or liability that cannot lawfully be excluded or limited. This provision concerns use of the Website and does not displace the terms or laws governing legal services that Cream Legal has agreed to provide.
